Terms of Service

1. Introduction

Welcome to Psycho.AI (the “Site”), accessible at psychotest-ai.com. These Terms of Service (“Terms”) govern your access to and use of the Site. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

These Terms constitute a legally binding agreement between you and the operator of Psycho.AI (“we”, “us”, “our”).

2. Entertainment Only — Not a Diagnosis

Psycho.AI is a novelty entertainment product. The test, its questions, scores, ranks, verdicts, cards, and any content generated by the Site are provided for entertainment purposes only. Nothing on the Site constitutes:

  • A psychological, psychiatric, or medical diagnosis
  • Therapeutic advice or professional mental-health guidance
  • A scientific measurement of any personality trait
  • An assessment usable in any clinical, legal, or hiring context

Do not make personal, medical, or life decisions based on your results. If you or someone you know is experiencing a mental-health crisis, contact a licensed professional. In the United States, dial 988 for the Suicide and Crisis Lifeline.

3. Age Requirement

You must be at least 13 years old to use the Site. If you are between 13 and 17, you may only use the Site with the consent of a parent or legal guardian, and you may only make purchases with their explicit permission and payment method.

If you are under 13, you may not use the Site. We do not knowingly collect information from children under 13. If we discover that we have received information from a user under 13, we will delete it.

4. Your Photo — What Happens to It

The Site invites you to upload a photo (a “selfie”) to generate your result card. Your photo never leaves your device. Specifically:

  • The photo is processed entirely in your browser using client-side JavaScript.
  • The photo is never transmitted to our servers, our staff, or any third party.
  • The photo is stored temporarily in your browser’s session storage in order to render your result card, and is deleted automatically when you close the browser tab.
  • If you download or share the resulting card, the card image lives only wherever you save or send it.

You represent and warrant that any photo you upload:

  • Is a photo of yourself, or of a person who has given you explicit consent to use their likeness in this context;
  • Does not depict a minor under 13, unless you are the parent or legal guardian;
  • Does not violate any third party’s intellectual property, privacy, or publicity rights.

5. Purchases and Subscriptions

Optional paid features (card variants such as Holo, Gold, and Void, and Pro subscriptions) are sold through Whop at whop.com/psycho-ai. Payments are processed by Whop, not by us. Whop’s Terms and Privacy Policy apply to your purchase transactions.

Subscriptions (Pro Weekly, Pro Monthly) automatically renew at the end of each billing period until you cancel. You may cancel at any time through your Whop account. Cancellation takes effect at the end of the current billing period; no refund is issued for the period already paid. This is disclosed to you at the point of sale in accordance with California’s Automatic Renewal Law and similar state laws.

6. Intellectual Property

All content on the Site — including the software, code, text, design, imagery, brand marks, card variants, artwork, tests, questions, verdicts, and any output generated by the test other than your uploaded photo — is the property of Psycho.AI and is protected by copyright, trademark, and other intellectual property laws.

You may download and share your own result card for personal, non-commercial use on social media. You may not otherwise reproduce, distribute, modify, or create derivative works from any Site content without our prior written permission.

Your uploaded photo remains your property at all times.

7. Prohibited Uses

You agree not to use the Site to:

  • Generate results about a specific identifiable person other than yourself without their explicit consent;
  • Harass, defame, or harm any person, including by circulating a result about them without consent;
  • Reverse-engineer, decompile, disassemble, or attempt to extract source code from the Site;
  • Deploy any bot, scraper, crawler, or automated tool to interact with, monitor, or copy Site content;
  • Frame or embed the Site inside another site or application without our written permission;
  • Use the Site for any illegal purpose or in violation of any law;
  • Interfere with, disrupt, or attempt to gain unauthorized access to the Site or any related systems.

8. Disclaimer of Warranties

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY OR RELIABILITY OF ANY TEST RESULT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PSYCHO.AI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU HAVE PAID TO PSYCHO.AI IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.

10. Indemnification

You agree to indemnify, defend, and hold harmless Psycho.AI and its operators, affiliates, officers, employees, and agents from any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any third party’s rights, including uploading a photo without proper consent.

11. Changes to These Terms

We may revise these Terms from time to time. The most current version will always be posted here. If we make a change that we believe materially reduces your rights, we will use commercially reasonable efforts to notify you (for example, via a banner on the Site). Your continued use of the Site after any change constitutes acceptance of the revised Terms.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to their personal jurisdiction.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
